Grand Jury Indicts Woman For Kidnapping of Baby Kayden

Indictment paves the way for her return to Wisconsin to face charges.

MADISON -- A federal grand jury has indicted 31-year-old Kristen Smith on the charge of kidnapping for the abduction of newborn Kayden Powell from a home in Beloit.

Police say Smith, who is the baby's aunt, took the baby during a family gathering, then left him in a tote bag at an Iowa gas station after family members contacted her by phone.  There were indications she had faked being pregnant and may have intended to keep the child as her own. 

Smith was originally charged with kidnapping in U.S. District Court, but now will be returned to Wisconsin to face the charges she has been indicted on.  Her next court date is February 21st in Madison.

If convicted, Smith faces a maximum penalty of life in federal prison
