Family of Megan Wells Requests Special Prosecutor


Family and friends of Megan Wells celebrated outside the Ogle County Judicial Center Tuesday after a judge decided not to dismiss the misdemeanor charges against Marc Mongan. The  46-year-old is charged in the DUI boating accident that took Wells’ life.

“This is just a small victory,” said Megan’s father, Dave Swaziek. “We’ve got a lot of work ahead of us yet. But this was a good day.”

Mongan was absent from the courtroom as his lawyers made their motion to dismiss the misdemeanor charges of Operating a Watercraft Under the Influence and Reckless Operation of a Watercraft.. That motion has now pushed back to a new court date. Swaziek says he’s shocked that the motion is even being considered.

“How did we get to the point where he could have been acquitted today?” He asked, “Which basically says he’s not responsible. Like he wasn’t even there.”

The Swaziek’s attorney, Cynthia Koroll, filed two motions of her own. The first one would make the victim’s parents “parties to the case” under the Crime Victims Act, which lets them testify as victims of a crime.

“We believe that this will allow them to fully participate in the case, to receive copies of pleading, and to have what’s called legally, standing,” said Koroll.

Koroll also filed a motion to bring a special prosecutor on board, citing a conflict of interest between Mongan and Ogle County State’s Attorney Eric Morrow.
Mongan making a large donation to the Serenity Hospice and Home Foundation, of which Morrow is the Board President, right after a Grand Jury decided not to upgrade his charges to felonies.

“(They’re) ultimately hoping that a set of fresh eyes, a different prosecutor, might be willing to re-present to the Grand Jury,” explained Koroll.

“I think we’re at the tip of the iceberg on this,” said Swaziek. “I think there’s a lot more information that we’re gonna be finding out.”
